There are so many errors that landlords (and even legal representatives) make that cause their entire N4 case to be dismissed from the LTB. These are called FATAL ERRORS. This means, drafting it right is half the battle to win. The first section of The Landlords Guide: When Tenants Are Not Paying Rent in Ontario has it all.
When Tenants do not pay rent per the N4 Form notice served to them, you would file anL1: Application to evict a tenant for non-payment of rent and to collect rent the tenant owes(Form L1) to the LTB to wait for a hearing. The fees might change over the years but as of August 2024, the fee is $186.00 per L1 application filed.
Everyone who goes to the LTB anxiously waits for that Decision to be issued by an Adjudicator. An example of an Ontario LTB Order for non-payment of rent looks like the one I went through withFile Number: TNL-35025-21 Bollu vs. Spezzano case. This is the document you would take to your Sheriff's Office.
When you receive an LTB Order, you can use Openroom's new Rental Debt Ledger System to record the rental debt owedand share this debt with the credit bureaus to natively impact the tenant's credit score and credit history. This becomes very important when someone is pulling a credit check from Equifax and/or TransUnion. Read the difference between the two credit bureaus.
Who knew that even after your order, it's not over yet? You'll need to figure out what's next such as enforcement to garnish wages or go after the tenant's financial records through an examination hearing.
